ANC 3F RESOLUTION OBJECTING TO THE APPLICATION FOR A NEW DRIVEWAY AND
CURB CUT IN PUBLIC SPACE AT 4618 – 38TH STREET, N.W.

WHEREAS, ANC 3F has received and reviewed the application for a 10-foot wide driveway and curb cut in public space at 4618 – 38th Street, N.W., which is located within SMD 3F06; and
WHEREAS, ANC 3F has heard no opposition from neighbors to a driveway and curb cut at this address; but
WHEREAS, in inspecting the premises, ANC 3F has found that a utility pole is located at the north end of where construction of the driveway apron would be if it is constructed according to the plan submitted with the application; this utility pole is not shown on the applicant’s plan; and
WHEREAS, for safety reasons the driveway and driveway apron should not be constructed as shown in the plan because of the danger of vehicles hitting the utility pole; and
WHEREAS, the driveway has already been built from the sidewalk to the rear of the house, including the part within the “parking” for 38th Street between the sidewalk and the building restriction line, leaving only the driveway apron to be constructed; and
WHEREAS, the driveway as built does not conform to the plan submitted with the application; instead, there is an additional small curve to the south just west of where the driveway meets the sidewalk, making the driveway at the sidewalk 12 feet wide, not 10 feet as stated in the application; and
WHEREAS, although the sidewalk in front of this property appears to be relatively new, several squares are cracked, suggesting that they have had to sustain loads that were too heavy for them during construction of the home at 4618 – 38th Street;
THEREFORE, BE IT RESOLVED THAT, ANC 3F requests that the Public Space Committee require the property owner to modify the plans for the driveway and driveway apron so as to place them a safe distance away from the utility pole, or require the property owner to move the utility pole, and recommends that in either case, the driveway not be increased to more than 10 feet in width; and
BE IT FURTHER RESOLVED THAT, ANC 3F recommends that the Public Space Management Administration send a copy of this application to Pepco if it has not already done so; and
BE IT FURTHER RESOLVED THAT, if the driveway cannot be repositioned or the utility pole moved, ANC 3F recommends that the application for a new driveway be denied and the driveway that has been constructed be removed; and
BE IT FURTHER RESOLVED THAT, ANC 3F requests that the owner of 4618 – 38th Street, N.W., repair the cracked squares in the sidewalk in front of the house.
