1. CALL TO ORDER [7:30 pm]
Chair Wiss called the meeting to order and, finding Commissioners Kogan, Perry, Maudlin, Bardin, Mitchell and Strauss to be present, declared a quorum.

2. AGENDA [7:32 pm]
The proposed agenda [attached] was approved by consensus.

3. MINUTES [7:37 pm]
Minutes of the June 17, 2002, meeting were approved 7-0-0 on motion of Commissioner Bardin, seconded by Commissioner Perry.

4. ANNOUNCEMENTS [7:38 pm]
A. Commissioner Maudlin announced the Bodywise "Walk Around the World" on Saturday, September 28, starting and ending at UDC's Denard Plaza and passing embassies and chanceries. He introduced Jim O'Donnell, Chair of the Council on Aging, who left registration materials.
B. Calling attention to three Brief Reports (on reverse side of the Agenda [attached]):
1. Commissioner Bardin announced training programs in neighborhood emergency preparedness for community leaders, Wednesday, September 18 at 7:30 pm at Washington Hebrew Congregation, 3935 Macomb Street, NW, and Thursday, September 19 at 6:30 pm at Chevy Chase Community Center, 5601 Connecticut Avenue, NW.
2. Commissioner Maudlin announced the scope of work document for the Military Road / Missouri Avenue Crosstown Transportation study had been issued by DDOT for comment.
3. Commissioner Perry called attention as to the Connecticut Avenue Traffic Study.
C. Commissioner Perry introduced DDOT's new Ward 3 traffic planner, Colleen Smith, who said she is available to work with the community on all studies, and can be reached at:

She deferred other remarks to the Open Forum.
D. Commissioner Wiss announced that Tenleytown Neighbors Association is again sponsoring a Tenleytown History Day on Saturday, October 5, from 11am-5 pm centered on the 4400 block of Grant Road, including tours of Tenleytown, Armesleigh Park, Methodist Cemetery (behind the Hechinger's Building) and possibly Fort Reno. This is a pot luck event.
E. Commissioner Wiss announced that the Potomac Watershed Partnership will hold a Growing Native Day on October 12 during which they seek seeds of native species picked up in our area. See www.growingnative.org or 703/222-6154 or 703/217-0003.

5. OPEN FORUM [7:50 pm]
A. Peter Halle of 2801 Chesterfield Place alerted the ANC to plans for three lots subdivided some time ago out of 2800 Chesterfield Place. The proposal involves modification of the existing house and the construction of two houses on lots facing Broad Branch Road. one involving renovation and two (facing Rock Creek Park). The lot sizes are 7,531, 17,706 and 7,817 square feet respectively. A concept plan is due to be considered by the Commission of Fine Arts (CFA) on September 19. Mr. Halle and Commissioner Maudlin had discussed the matter with the CFA staff and Commissioner Maudlin had talked with the Applicant (Panoramic Design, Ltd. ) this day. The ANC approved the attached letter to the CFA on motion of Commissioner Maudlin, seconded by Commissioner Bardin, 7-0-0, asking the CFA to defer decision so that the ANC may fully consider the proposals at its October meeting and offer its recommendations.
B. Carol Woodard of 3003 Van Ness Street asked: Who is not running for re-election? Commissioners Mitchell, Strauss and Kogan said that they are not running.
C. Barbara Beelar, of 3505 Tilden Street, alerted the ANC to the letter submitted by the Hearst Recreation Advisory Council on September 13 to Neil O. Albert, Director of DC Parks and Recreation. The Center will be in ANC 3F after redistricting becomes effective in January.
D. Colleen Smith spoke about DDOT's program to prioritize all of its projects (repaving, signage, traffic calming, trees, etc.) on five-year and 10-year timetables. She promised to fax to the ANC commissioners who wanted them a list of all DDOT's present projects in Ward 3 seeking inputs as to priorities by October 21. She is open to ideas for projects not on the list.
1. Chair Wiss sought volunteers to help the ANC develop priority recommendations. None came forward at the time.

2. Dick Potter of 3003 Van Ness Street suggested turning to the full membership of the SNAP planning group, which works with Robert Collins of the Office of Planning, for potential volunteers.
E. Chair Wiss put off to October discussion with the new Franklin Montessori School at 4473 Connecticut Avenue.

6. MPD SECOND DISTRICT REPORT [8:18 pm]
Officer Gillikin supplied statistics for PSA 201, not ANC 3F (which includes parts of PSAs 201, 202 and 204). He had limited information about the proposal to split PSA 201 in two, along Nebraska Avenue. He can be reached at trubandit2001@hotmail.com and offered to try to find answers, and said he had some maps in his car, but suggested that Chief Ramsey was the key source of information. Commissioner Kogan asked June Brereton, resident manager of the Ponce de Leon apartments, 4514 Connecticut Avenue, whether that description was helpful. She expressed appreciation and hopes splitting a new PSA to serve between Nebraska and Porter would enhance service to this neighborhood.

7. PUBLIC SPACE APPLICATION FOR NEW DRIVEWAY CUT AT 2900 ALBEMARLE STREET, NW [8:40 pm]
Commissioner Kogan described issues posed by the proposal for yet one more driveway cut through the public space at this location on the south side of Albemarle Street, exactly at the bare 40 feet (the minimum distance allowed) from the intersection with 29th Street. Albemarle slopes downward toward that intersection. Brendan Herron, who lives across Albemarle Street from the intersection, described his wife's informal traffic survey from 3:45 to 5:15 pm that same afternoon: 214 cars passed down hill and 90 uphill, about one car every 20 seconds and going downhill two-thirds of the time. Of those traveling downhill, only one out of three stopped at the stop sign. Questions by Commissioner Maudlin elicited that the proposed cut would serve a blind driveway, coming out to Albemarle just south of (i.e., downhill from) a retaining wall necessitated because the developer intends to excavate so as to drop the elevation by five to seven feet and must hold the soil on the higher, Connecticut-Avenue-side. Moreover, there would be a seven-foot-high fence on top of the retaining wall. In contrast, the existing curb cut on Albemarle Street, further to the west, is 75-80 feet from the intersection and not blinded by visual obstructions. Under the governing rules, curb cuts should not endanger public safety. The ANC approved Resolution 02-29 [attached] on motion of Commissioner Kogan, seconded by Commissioner Perry, 6-0-1 (Commissioner Mitchell abstaining).

8. PUBLIC SPACE APPLICATION FOR DRIVEWAY CUT AT 2800 DAVENPORT STREET, NW [8:56 pm]
Commissioner Maudlin explained that the ANC had previously reviewed a proposal to build a bridge (over the unnamed tributary of Broad Branch that runs along Davenport) to which the ANC did not object, subject to two conditions. A permit to build the bridge has issued and the bridge was built. The current curb cut application is ancillary to the bridge application. On motion of Commissioner Maudlin, seconded by Commissioner Bardin, the ANC agreed to respond that it has no objection, 7-0-0.

9. Application #16925 to BZA for SPECIAL EXCEPTION TO LOT SIDE YARD REQUIREMENT FOR 3558 ALBEMARLE STREET, NW [8:59 pm]
Chair Wiss passed the gavel to Vice-Chair Kogan. 
Commissioner Wiss discussed the proposed construction on this grandfathered, non-conforming lot with owners, Louise and Mark Novitch, and their architects, Steven Muse and Kuk-Ja Kim, and reported on contacts she had made with adjacent landowners. Special Exception from the BZA is sought solely to extend the house and deck southward, parallel to the property line and closer to that line than the minimum 8-foot side yard. Part of the reason is to make room to save a 16-foot-circumference tulip poplar, much loved by the Novitches and their neighbors. Mr. Novitch said that this tree may be 175 years old. There was no opposition and some support from neighbors to the project. The ANC approved Resolution 02-30 [attached] on motion of Commissioner Wiss, seconded by Commissioner Mitchell, 7-0-0.
Vice-Chair Kogan returned the gavel to Chair Wiss.

10. Application to HPRB FOR CONCEPT REVIEW OF ROOF ALTERATION AT LEVINE SCHOOL OF MUSIC (CARNEGIE GEOPHYSICAL INSTITUTE), HPA #02-481 [9:30 pm]
Commissioner Perry presented the background and introduced the representatives of the Levine School of Music, architect Colden Florance, Board of Trustees Member Stan Spracker, and Dean Kathleen Wilson. The ANC approved Resolution 02-31 [attached] on motion of Commissioner Perry, seconded by Commissioner Maudlin, 6-0-1 (Commissioner Strauss abstaining).

11. DCRA CONSTRUCTION PERMIT FOR 5105 LINNEAN AVENUE, NW
The ANC approved Resolution 02-32 [attached] on motion of Commissioner Maudlin, seconded by Commissioner Perry, 7-0-0.

12. DESIGNATION OF ADDITIONAL COMMISSIONER TO REPRESENT ANC IN FOREST HILLS TREE & SLOPE PROTECTION OVERLAY, ZC Case No. 02-19 [10:22 pm]
The ANC designated Commissioner Wiss as an additional commissioner to represent the ANC before the ZC by consensus, 7-0-0.

13. TREASURER'S REPORT [10:25 pm]
Treasurer Mitchell presented the financial results and three resolutions:
The ANC approved Resolution 02-33 [attached] to amend the approved budget on motion of Commissioner Mitchell, seconded by Commissioner Perry, 7-0-0.
The ANC approved Resolution 02-34 [attached] to authorize expenditures on a "continuing resolution" basis after the new fiscal year begins (on October 1) on motion of Commissioner Mitchell, seconded by Commissioner Perry, 7-0-0.
The ANC approved the Quarterly Financial Report to the DC Auditor [attached] on motion of Commissioner Mitchell, seconded by Commissioner Perry, 7-0-0.
Treasurer Mitchell also presented a report for August for the commissioners' information.

14. OTHER BUSINESS
There was some discussion about future budget policies to support neighborhood needs for expert advice and communications with constituents who lack access to the internet.

15. ADJOURNMENT [10:53 pm]
By consensus, the ANC adjourned, 7-0-0. Next meeting: October 21, 2002, at 7:30 pm at the Capital Memorial Seventh-Day Adventist Church.
