1. CALL TO ORDER [7:31 pm]
Chair Wiss called the meeting to order and, finding Commissioners Kogan,
Perry, Maudlin, Bardin, and Strauss to be present, declared a quorum.
2. AGENDA [7:37 pm]
The proposed agenda [attached] was approved by consensus.
3. MINUTES [7:38 pm]
Minutes of the September 17, 2002, meeting were approved 6-0-0 on motion
of Commissioner Bardin, seconded by Commissioner Perry. Minutes of
the October 7, 2002, special meeting were approved 5-0-1 (Commissioner
Strauss abstaining) on motion of Commissioner Bardin, seconded by Commissioner
Maudlin.
4. ANNOUNCEMENTS [7:39 pm]
A. Commissioner Maudlin announced:
1. On November 2, all day, DPW will hold the annual hazardous
materials disposal day and receive household hazardous waste at the Carter
Barron Amphitheater parking lot.
2. On October 27 beginning at 10:30 am the annual Halloween
Bash will take place at the Forest Hills Playground. Volunteers should
contact Laura at 244-9924.
B. Commissioner Bardin announced presentation of the DC
Strategic Transportation Plan on October 22 at 7:30 pm at the Sumner School,
17th and M Streets during the DC Federation of Citizens Associations monthly
meeting.
C. Barbara Kogan announced the new, US Department of Agriculture
rules on organic foods labeling and described approaches being taken by
local supermarkets.
5. OPEN FORUM [7:43 pm]
A. Jim Wigand presented a petition signed by 19 residents
of the 3700 block of Chesapeake Street asking that the new signal light
at Chesapeake and Nebraska be set to prevent vehicles moving eastbound
or westbound on Chesapeake from crossing Nebraska. John Turner of
3713 Chesapeake supported the petition, describing how a passing vehicle
had hit and damaged his car. They asked for early agenda consideration,
preferably at the November meeting.
B. Joan Benesch of 4444 Linnean asked whether the Fortune
teller on Connecticut Avenue needed City permission to place its advertising
stanchion on the sidewalk. Commissioner Perry answered in the affirmative
and said she would contact the public space regulatory office.
C. Christine Wilson of PEPCO reintroduced herself.
6. MPD SECOND DISTRICT REPORT [8:00 pm]
Officer Gillikin had no statistics available because of attention
being concentrated on the search for a sniper. He described
two recent robberies at the Exxon station on Connecticut near Morrison
and at Politics and Prose.

Candidates for election to the ANC made brief presentations in the

TO ANC NAME EFFECTIVE JANUARY 2003 [8:35 pm]
The ANC adopted Resolution 02-35 [attached] on motion of Commissioner
Bardin, seconded by Commissioner Wiss. 7-0-0 (Commissioner Wiss casting
Commissioner Mitchell's proxy).
9. DELHI DHABA, INC. T/A DELHI DHABA, 4455 CONNECTICUT
AVENUE, APPLICATION # 50170 TO ABRA FOR CLASS "CR" LIQUOR LICENSE FOR ITS
SIDEWALK CAFÉ [8:40 pm]
After discussion with Paul Dumiere, appearing on behalf of the
applicant, the ANC approved the attached Voluntary Agreement and letter
to the ABC Board on motion of Commissioner Perry, seconded by Commissioner
Maudlin. 7-0-0 (Commissioner Perry casting Commissioner Mitchell's
proxy).
10. KURI BROTHERS, INC. , BZA Appeal #16947 OF DCRA REVOCATION
OF CERTIFICATE OF OCCUPANCY FOR AN AUTOMOBILE SERVICE CENTER AT 4221 CONNECTICUT
AVENUE [8:53 pm]
The ANC approved Resolution 02-36 [attached] on motion of Commissioner
Perry, seconded by Commissioner Bardin. 7-0-0 (Commissioner Wiss
casting Commissioner Mitchell's proxy.) On motion of Commissioner
Bardin, seconded by Commissioner Perry, the ANC authorized its representatives
for this matter (Commissioners Bardin and Perry) (a) to explore whether
they needed legal advice and, if so, (b) to circulate a paper defining
that need for timely review by the other commissioners (noting that the
BZA hearing is scheduled for November 12, prior to the next ANC meeting)
and (c) approved an expenditure of up to $1,000 to secure legal advice
on the foregoing basis. 6-0-0.
11. TRANSPORTATION CAPITAL PROJECT PUBLIC INVOLVEMENT
PROCESS [9:14 pm]
Chair Wiss passed the gavel to Vice-Chair Kogan.
Commissioner Wiss discussed the DDOT procedure and tight timetable
and the survey of streets in the ANC that she, Mary Clark, Barbara Kogan
and Marvin Tievsky had conducted on short notice, as a volunteer committee
(following up the announcement of DDOT's request for input at the ANC's
September 17 meeting). The ANC, after considering observations and
materials (including photographs) furnished, approved the attached letter
to DDOT [Ltr 02-04] on motion of Commissioner Wiss, seconded by Commissioner
Perry. This letter recommends priorities for each of six of the projects
on the DDOT list furnished to the ANC . At a subsequent meeting,
the volunteer committee may propose an additional letter. Acting
Chair Kogan expressed the ANC's appreciation for the good work of the volunteer
committee.
Vice-Chair Kogan returned the gavel to Chair Wiss.
12. TREASURER'S REPORT [9:49 pm]
Chair Wiss provided copies of Treasurer Mitchell's report for
September for the commissioners' information.
13. OTHER BUSINESS
Commissioner Maudlin reminded the ANC that its annual report
under the By-Laws is due to be adopted at the November meeting.
14. ADJOURNMENT [9:57 pm]
By consensus, the ANC adjourned, 6-0-0. Next meeting: November
18, 2002, at 7:30 pm at the Wisconsin Avenue Baptist Church, entrance on
Alton Place off Tenley Circle..
