1.         CALL TO ORDER [7:30 pm]

Chair Wiss called the meeting to order and, finding Commissioners Kessler, Perry, Maudlin, Bardin, and Bernardi to be present, declared a quorum.

 

2.              AGENDA [7:35 pm]

The proposed agenda was approved, 6-0-0.

 

3.              MINUTES [7:36 pm]

Minutes of the September 29, 2003, meeting were approved, on motion of Commissioner Bardin, seconded by Commissioner Bernardi.  5-0-1 (Commissioner Perry abstaining).

 

4.            ANNOUNCEMENTS [7:38pm]

            A.              Announcements by Commissioners:

            Commissioner Bardin:  D.C. WASA invites you to a discussion of Citizens’ Role in Cleaning DC’s Waterways, Wednesday, October 22 at 6:30 pm at Watha T. Daniel/Shaw Branch Library, 1701 8th Street and Rhode Island Avenue.

            Commissioner Wiss:  First, OP will unveil its Upper Wisconsin Avenue Corridor Plan on October 27, as 7 pm, at St. Columba’s Church. 

            Second, Commissioner Trudy Reeves, ANC 3C06, seeks volunteers to address excessive lighting issues concerning the MacDonald’s at Wisconsin Avenue and Van Ness Street.  Her phone number is 202/364-8897.

 

            B.            Announcements by members of the community:

            Dick Potter: He and Carol Woodard praise the ANC for its new sound system.

            Janice Bolt (4221 39th Street) announced that the Mayor’s Citizen Summit III will be held on November 1, 2003, from 8am to 2pm at the New Convention Center (Mt. Vernon Square Metrorail stop on the Green or Yellow lines).  Pre-registration has reached 1,500.  Lunch will be provided.  She distributed registration kits.

            Jill Diskan, Neighborhood Services Coordinator:  Mayor will be at St. Columba’s tomorrow, 7:30-9pm, open to everybody (not just Ward 3 Democrats, the sponsors).

            Update on Wilson H.S. swimming pool:  Damage turns out more extensive than the fallen wall and pool will probably not reopen before October 2004.  DPR is arranging for some use of UDC pool in the interim.   DCPS will issue press release.  For more info contact her at 202/282-7952 (her office at branch library, except for M and Tu) or 727-2291 (Wilson Building, Mondays and Tuesdays) or cell 202/359-0895 or jill.diskan@dc.gov.

            Clean up of debris from Isabel pick ups from October 6th to 26th; contact her or 727-1000 in case of problems.

            George Clark:  First, FHCA & Friends of the Forest Hills Playground will hold the annual Halloween Parade and costume event on Saturday, October 25, from 10 to noon. 

            Second:  On the same Saturday,  from10am to 4pm, Murch School will hold its Fall Fair.

 

5.         OPEN FORUM [7:55pm]          

Barbara Kogan (4501 Connecticut Avenue, #102) discussed nutrition labeling at area supermarkets.

Henry Guyot is looking for volunteers to help address the McDonald’s lighting.  He can be reached at 202/362-6474.

Dick Randall (Cleveland Park) again circulated a petition regarding obtrusive signs put up by American University at 4200 Wisconsin Avenue (and Van Ness Street, in ANC 3F06).

 

6.         MPD SECOND DISTRICT REPORT [8:02 pm]

            Lt. Aiello reported  29 events in ANC 3F between September 15 and October 29: 

2 robberies,  7 burglaries,  4 thefts,  4 stolen autos, 8 thefts from autos, and 4 other. 

            Lt. Aiello reported two October 9 crimes involving guns, one at 3200 Albemarle, close to midnight, the other 10 minutes earlier at Dominos Pizza on Wisconsin.  Thanks to positive identifications of the suspects and of the license tag number of their get-away car, police stopped and arrested them on Military Road, recovering two guns.  Lt. Aiello promised to find out the outcome of the arraignment the next day and the name of the judge presiding.

            Lt. Aiello reported a stress on truancy enforcement as a proven crime prevention method.

Councilmember Mendelson not having arrived, the Chair took up the next item on the agenda.

 

7.            SHERIDAN SCHOOL (BZA CASE NO. 16977) [8:19pm]

On motion of Commissioner Kessler, seconded by Commissioner Perry the ANC voted 6-0-0 in favor of adopting Resolution 03-21 [attached].

              

8.            COUNCILMEMBER PHIL MENDELSON [8:31 pm]


Chair Wiss introduced At-Large Councilmember Phil Mendelson discussed Bill 15-387 the Nutrition Information at Restaurants Act of 2003 and two other bills he has introduced.  Wayne Curtis and George Clark asked questions, as did some of the commissioners.

Commissioner Bardin moved, and Commissioner Wiss seconded approval of a letter of support for Bill 15-387.  The motion was defeated 2-4-0 (with Commissioners Bardin and Wiss in the minority).

 

9.         TREE IN PUBLIC SPACE AT 2800 CHESTERFIELD PLACE [9:10pm]

            Commissioner Maudlin moved, and Commissioner Perry seconded, approval of Ltr 03-06 [attached] to Mr. Steve Kehoe, Engineering Tech., Public Space Permits and Records Branch.  The motion carried 6-0-0.

 

10.            TRAFFIC CALMING FOR UPTON STREET BETWEEN RENO ROAD AND

             WISCONSIN AVENUE [9:11PM]

            DDOT’s Ward 3 Traffic Planner, Colleen Smith, orally presented  DDOT’s conclusions that most of the seven numbered traffic calming recommendations in a July 21, 2003, consultant’s report should be implemented.  DDOT’s conclusions were not distributed in writing to the ANC but were part of a DDOT memo dated October 14, 2003, received by the ANC from DDOT together with the consultant’s report the previous week and posted on the ANC’s web site on Sunday evening, October 19.  Chair Wiss distributed a one-page list of seven recommendations (lettered a. through g.), copied from a July 2003 consultant’s report.

            The ANC heard several residents of Upton Street and Van Ness Street and nearby streets: Chuck Ludlam, 4020 Reno Road; Anita Kuzio, 3601 Van Ness; Barbara Oliver, 3633 Van Ness; Sharon Flank, 3630 Upton; Sean Kennedy, 3641 Van Ness; Norman Dong, 3624 Van Ness (who announced that he is circulating a petition for a traffic calming study as to the 3600, 3700 and 3800 blocks of Van Ness Street); Brenda Viehe Vaess, 3625 Van Ness; Bill Coe, 3622 Van Ness; Henry Guyot, 4108 38th Street; Jane Panagis, 4107 38th Street.

            Upton Street residents generally favored the DDOT recommendations reasoning that they would slow traffic on Upton Street, not move traffic to other streets.  Van Ness Street residents generally predicted that those recommendations would significantly induce traffic to go from Upton to Van Ness Street.

            Colleen Smith said (a) that there is no way of knowing whether and to what extent traffic patterns will shift until a new study is made, as part of the project, six months after implementing the recommendations; and (b) that traffic ought to go “back” to Van Ness Street, which is classi-fied as a collector street whereas Upton Street is a local street.

            Commissioner Kessler moved, and Commissioner Bernardi seconded, that the ANC not object to DDOT’s proposed Upton Street traffic calming measures.  On motion of Commissioner Bardin, seconded by Commissioner Perry, the ANC voted to table the motion, 4-2-0 (Commis-sioners Kessler and Wiss dissenting).

 

11.            REQUEST FOR 90-DAY PERIOD TO RESPOND TO UPPER WISCONSIN            

            AVENUE CORRIDOR STUDY - STRATEGIC FRAMEWORK PLAN [9:55pm]

            Commissioner Wiss, Jill Diskan, and Matt Pavuk (4426 Grant Road) described the present situation.  Commissioner Wiss moved, and Commissioner Kessler seconded, approval of a letter  to OP seeking a 90-day extension.  Maudlin motion to delete a sentence at end of second paragraph (reading “ANC 3F also joins ANC 3E in requesting that no applications for map amendments in the study area be set down prior to the release of the final Study.”).  The motion to amend died for want of a second.  Then, Commissioner Wiss, with her second, Commissioner Kessler concurring, amended that sentence to apply to set downs of Planned Unit Development proposals as well as map amendments (the position that ANC 3E had taken).  The ANC approved that motion, 5-1-0 (Commissioner Maudlin dissenting).

 

12.            LIQUOR LICENSE RENEWAL FOR CLOVER MARKET, 5014 CONNECTICUT             AVENUE [10:15pm]

            On motion of Commissioner Bernardi, seconded by Commissioner Bardin, approved a resolution of non-objection to renewal of the liquor license for this grocery store.  Res 03-22 [attached].  In response to inquiry, Commissioner Bernardi explained that she was following the ANC’s precedents in past renewals of seeking no voluntary agreement for Clover Market.

 

13.            TREASURER’S REPORT [10:17pm]

            The ANC received and noted the Treasurer’s Report for September 2003 and, on motion of Commissioner Kessler, seconded by Commissioner Bardin, the ANC by a vote of 6-0-0 added $200 to the FY 2003 budget to cover all rental payments to Mail Boxes, Inc. for the postal delivery box.

 

14.            ADJOURNMENT [10:27 pm]

The meeting adjourned.  The ANC will next meet at a regular monthly meeting, at the Capital Memorial Seventh-Day Adventist Church, 3150 Chesapeake Street, N.W., on Monday, November 17, 2003, at 7:30 pm.
