1.         CALL TO ORDER [7:30 pm]

Chair Wiss called the meeting to order and, finding Commissioners Kessler, Perry, Maudlin, Bardin, Bernardi, and Dennis to be present, declared a quorum.

 

2.              AGENDA [7:31 pm]

The proposed agenda was approved, 7-0-0, after deletion of two items by the Chair (Proposed high-density zoning overlay for R-5-D district; and D.C. Bill 15-264, ABC Board Affected ANC Amendment Act).

 

3.              MINUTES [7:33 pm]

Minutes of the October 20, 2003, meeting were approved, on motion of Commissioner Bardin, seconded by Commissioner Bernardi.  7-0-0.

 

4.            ANNOUNCEMENTS [7:36pm]

A.              Announcements by Commissioners:

Commissioner Bardin:  An SMD 3F04 meeting will be held on Monday, December 8, at 7 pm, at the Capital Memorial Church, to discuss BZA Application No. 17105 for a nursery school at the Church (plus open forum subjects).

Commissioner Maudlin :  Most of that BZA Application is posted on the ANC web site.

Commissioner Kessler:  Residents of Van Ness, Veazey, 37th and 38th Streets are meeting with DDOT on December 5th to discuss traffic calming measures.  He and Commissioner Wiss are planning a joint SMD 3F01 and 3F06 meeting on Thursday, December 11, at 7:30 pm to discuss traffic calming for Upton Street and streets to the north.  They hope to hold that meeting at the Wisconsin Avenue Baptist Church.

Commissioner Maudlin: Office of Peoples Counsel is holding two consumer forums regarding Pepco=s power outages of August and September:  (a) Saturday, December 6, 9:30-11:30 am at the new Washington Convention Center; and (b) Tuesday, December 9, 6:30-8:30 pm at the historic  Sumner School, 1201 17th Street.

Commissioner Perry:  The Connecticut Avenue Traffic Study is now in final form and available at the Cleveland Park and the Tenley-Friendship Libraries.  There will be a public forum early next to go over the recommendations.

Commissioner Wiss:  OP will hold a public forum on Monday, December 8, at 7 pm, at St. Columba=s Church, to discuss its Draft Upper Wisconsin Avenue Corridor Study B Draft Strategic Framework Plan.  The draft should be up on OP=s web site by Thursday according to Cindy Petkac, OP=s Ward 6 and Ward 3 Planner. 

B.            Announcements by members of the community:


Dick Potter: Victor McCoy, manager of the Friendship Post Office on Wisconsin Avenue (in ANC 3F) has established an Advisory Council of about 10 people which will hold its first meeting on December 2 (at 11:30 am).  As to collection boxes, he expects restoration of the three boxes near the Van Ness/UDC Metro Station once construction is finished.

Several members of the community (including some of the commissioners) had attended the Mayor=s Citizen Summit III which was rescheduled and held on November 15, 2003, at the New Convention Center.

 

5.         OPEN FORUM [7:55pm]          

Jill Diskan, Neighborhood Services Coordinator is trying to find out what is going on with 4345 Wisconsin Avenue.  She and members of the community and Councilmember Patterson=s Office (represented by Michelle Cole at the meeting) have heard various stories.

Stephanie Smith Kinney (3607 Van Ness Street) spoke briefly about efforts of her neighbors to address their traffic calming concern and provided copies, signed by varying numbers of people, of two documents:  APetition Regarding Proposed Traffic Calming Plan for Upton Street NW@ and APetition for Traffic Calming Devices on Van Ness Street NW.@  The latter consists of 16 pages with 40 undated signatures and addresses in the 3600 block of Van Ness Street.  The former consists of 45 pages with dated signatures and addresses on Van Ness, Veazey, 37th and 38th Streets.  (They do not appear to include residents of Warren, Windom, or Yuma to which that Petition also refers.)   [The copies of both Petitions are in the ANC=s file.]

Wayne and Dina Curtis (3685 Upton Street) spoke briefly about concerns of Upton Street residents and distributed a copy of AViews of Upton Street Community Regarding DDOT Traffic Calming Recommendations@.  [That document is in the ANC=s file.]

 

6.         MPD SECOND DISTRICT REPORT [8:12 pm]

Lt. Aiello reported  31 events in ANC 3F between October 12 and November 12, including one robbery, four burglaries, 12 thefts, 12 thefts from autos, and two stolen autos.

Last month, Lt. Aiello reported two October 9 crimes involving guns and arrest of two suspects on Military Road, recovering two guns.  Commissioner Bardin reported that the U.S. Attorney=s Office advises that they expect these suspects to remain in custody until their cases are resolved.

Commissioner Wiss reported information of homeless presence in garages between Upton and Van Ness Streets.

 

7.            SIDEWALK CAFÉ AT TRATTORIA LILIANA, 4883 CONNECTICUT AVENUE [8:25pm]

Commissioner Maudlin explained that the sidewalk café would have planters, like Shanghai Gardens and Delhi Dhaba, to delineate the area.  Designer John Hutson and Michel Dumas manager of the restaurant confirmed the applicant=s willingness to accept such a condition.

On motion of Commissioner Maudlin, seconded by Commissioner Perry the ANC voted 7-0-0 in favor of adopting Letter 03-08 [attached] to the Public Space Committee.

              


8.            EXISTING PAY PHONE IN PUBLIC SPACE AT 4339 CONNECTICUT AVENUE [8:30 pm]

On motion of Commissioner Perry, seconded by Commissioner Bernardi, the ANC voted 7-0-0 to approve Resolution 03-23 (attached).

 

9.            PEDESTRIAN SAFETY MEASURES AT CONNECTICUT AVENUE AND WINDOM PLACE [8:39 pm]

Commissioner Bardin moved, and Commissioner Bernardi seconded, approval of Letter 03-09 [attached] to DDOT Director Dan Tangherlini (with copy to Ward 3 Transportation Planner Colleen Hawkinson [nee Smith].  Approved 7-0-0.

 

10.            REQUEST FOR ANO DOUBLE PARKING@ SIGNS ON VAN NESS STREET, EAST OF CONNECTICUT [8:44pm]

Commissioner Perry moved, and Commissioner Maudlin seconded, approval of Letter 03-10 to DDOT Director Tangherlini.  Approved 7-0-0.

 

11.            LETTERS IN RESPONSE TO BZA TO SUPPLEMENT RECORD IN EDMUND BURKE SCHOOL APPLICATION [8:50pm]

(a) Commissioner Perry, seconded by Commissioner Kessler, moved approval of Letter 03-11 to the BZA in response to its inquiry in relation to admission in evidence of a traffic related letter from a MPD Lieutenant who was not available for cross examination.  Approved 5-1-0 (Commissioner Bernardi dissenting; Commissioner Bardin recused).

(b) Commissioner Perry, seconded by Commissioner Maudlin, moved approval of Letter 03-12 to the BZA in response to its inquiry regarding use of Howard University playing fields.  Approved 3-2-1 (Commissioners Bernardi and Dennis dissenting; Commissioner Wiss abstaining; Commissioner Bardin recused).

 

12.            LIQUOR LICENSE RENEWAL FOR TENLEY MINI MARKET, 4326 WISCONSIN AVENUE [9:03pm]

On motion of Commissioner Wiss, seconded by Commissioner Bardin, approved (7-0-0) a letter of non-objection to renewal of the Class AB@ liquor license (Application No. 21283) for this grocery store (Y & K Business Associates, Inc. T/A Tenley Mini Market).  Letter 03-13 [attached].

 

13.       ANC 3F REPRESENTATION ON BUILDING CODE ADVISORY COMMITTEE AND PURCHASE OF BOOKS [9:08 pm]

(a)  Commissioner Bardin, seconded by Commissioner Bernardi, moved approval of Letter 03-14 [attached] to the Chair of the Mayor=s Office of Board=s and Commissions.  Approved, 7-0-0.

(b)  Commissioner Dennis, seconded by Commissioner Bernardi, moved that the ANC budget up to $400 for purchase of the current Building Codes and of the set of Codes to be considered for adoption in the next D.C. code approval cycle.  Approved, 7-0-0.

 

14.            TREASURER=S REPORT [9:17pm]

O n motion of Commissioner Kessler, seconded by Commissioner Perry, the ANC approved the 4th Quarter Report for FY 2003 to the DC Auditor.  7-0-0.

The ANC received and noted the Treasurer=s Report for October 2003.


 

15.       ANC 3F ANNUAL REPORT FOR FY 2003 [9:26]

On motion of Commissioner Bardin, seconded by Commissioner Bernardi, the ANC approved (7-0-0) the Annual Report for FY 2003 to the Mayor and D.C. Council [attached].

 

16.            ADJOURNMENT [9:30 pm]

The meeting adjourned.  The ANC will next meet at a regular monthly meeting, at the Capital Memorial Seventh-Day Adventist Church, 3150 Chesapeake Street, N.W., on Monday, December 15, 2003, at 7:30 pm.
