1. CALL TO ORDER [7:30 pm]
Chair Wiss called the meeting to order and, finding Commissioners
Kessler, Perry, Maudlin, Bardin, Bernardi and Dennis to be present, declared
a quorum.
2. AGENDA [7:32]
The proposed agenda [attached] was moved by Commissioner Wiss
and seconded by Commissioner Perry. Commissioner Maudlin offered
an amendment to move the BZA Appeal No. 16982 item up to be considered
after the approval of the February minutes because Commissioner Bardin
would be leaving the meeting at 8:00pm. The agenda was approved as
amended.
3. MINUTES [7:35]
Minutes of the February 10, 2003, meeting were approved, on motion
of Commissioner Bardin, seconded by Commissioner Maudlin.
4. BZA APPEAL No. 16982, 2900/02 ALBEMARLE STREET, N.W.
AND PETITION TO ZONING COMMISSION[7:36]
Commissioner Bardin reported that on March 11, the BZA dismissed,
as untimely, the appeal filed by the ANC and Mr. Herron as to issues involving
zoning at 2900/02 Albemarle Street.
Commissioner Bardin also reported that in working on the appeal
he found an error in the vesting and set down provisions in Section
3202.5(a) of the Zoning Regulations as published in a new edition of the
DCMR. He presented a draft petition to the Zoning Commission requesting
action to restore the 1987/88 rule either by an emergency rule or by declaring
that the inadvertent error was a nullity. On motion of Commissioner
Bardin, seconded by Commissioner Perry, the ANC voted 7-0-0 approving the
concept of the petition. Attached Document 03-01.
5. ANNOUNCEMENTS
A. Commissioner Perry announced a meeting on the Connecticut
Avenue Traffic Study at 7:00pm on April 1, in the Social Room, Van Ness
South, 3003 Van Ness Street, N.W.
B. Commissioner Bardin reported that the Department of
Parks and Recreation will have a meeting on March 22, at 8:30am to 4:00pm
on the adopt-a-park program.
C. Commissioner Bardin reported that he had filed comments in
the ZC’s Building Height rulemaking (Case No.02-35)
He also announced that Steve Gresham had agreed to serve on ANC3F’s
ad hoc committee on building heights. A motion by Commissioner
Bardin, seconded by Commissioner Perry was adopted by consensus to add
Mr. Gresham to the ad hoc committee.
D. Commissioner Maudlin reported that on March 14. The National
Park Service announced the availability of a General Management Plan, Draft
Environmental Impact Statement for Rock Creek Park which evaluates four
alternatives for the park. Two of the alternatives provide for closing
three northern sections of Beach Drive to vehicular traffic.
E. Commissioner Kessler reported that groups and individuals
would have until the May 20, hearing of the Sheridan School BZA case to
file for party status in the proceeding. (Filings are required 14
days prior to the hearing.)
F. Gary Stevens, president FHNA, announced a joint FHNA and FHCA
meeting at 7:30-9:30pm, April 2, at the Capital Memorial Church, on the
studies of Forest Hill’s history. He also said that there would be
a report on status of the Owl’s Nest.
(Note: Commissioner Bardin left the meeting at 8:06pm.)
G. Jill Diskan, Ward 3 Service Coordinator, announced that Ward
3 would participate in the Great American Clean-up with an eight-week program
starting March 29. Ms. Diskan distributed applications for groups that
want to participate in the clean up.
Ms. Diskan also reported than requests for October tree planting
to replace DC trees should be made ASP and no later than June 15, by calling
727-1000.
Ms. Diskan announced the second Ward 3 public meeting by Peter
LaPorte, Director Emergency Management Agency, in the library at Wilson
High School at 7:00pm March 31.
6. OPEN FORUM [8:17 pm]
A. Dorothy Biard, Chair Tenleytown Heritage Trail Work Group,
reported that the group is working to develop a Tenleytown Trail that will
be a walking trail highlighting the history of the area.
B. George Clark, just returning for a ZC hearing on building
heights, reported that at the hearing this evening the ZC received
testimony on building heights in residential districts but said the issue
would be taken up by the ZC at a latter date.
7. MPD SECOND DISTRICT REPORT [8:21 pm]
Lt. Robert Aiello reported that during the period February 10
to March 15, in the ANC3F area there were 1 assault, 3 robberies, 10 thefts,
6 thefts from auto, and 3 stolen autos and no burglaries. He provided
additional specifics as to day of week and circumstances of the reported
crimes and exchanged information with and from members of the community.
8. MEMORANDUM OF UNDERSTANDING BETWEEN THE DC FIRE DEPARTMENT
AND THE BETHESDA-CHEVY CHASE RESCUE SQUAD [8:33 pm]
Assistant Chief Dawson, B-CCRS and Battalion Fire Chief Watt,
DC Fire Department, discussed the MOU between the two groups and both reported
that it is working well to provide services to the upper northwest area.
They said the MOU is reviewed every several years and that there is no
proposal to reduce the services provided by the B-CCRS.
Commissioner Bernardi offered a resolution to strengthen the
agreement between DCFEMS and the B-CCRS which was seconded by Commissioner
Dennis. The resolution was approved 7-0-0 with Commissioner
Bernardi voting Commissioner Bardin’s proxy. Attached Res 03-05.
9. PUBLIC SPACE PERMIT FOR ENLARGEMENT OF DRIVEWAY APRON
AT 3007 TILDEN STREET, N.W. (INTELSAT) [9:01 pm]
Mr. Jason Jenkins of Intelsat, described a request for ANC3F’s
position on a revised application for a public space permit to increase
the width of Intelsat’s driveway at 3007 Tilden Street from 24 feet to
30 feet. ANC3F had offered no objection to the original application.
(See Res 02-15) Commissioner Kessler offered a resolution of “no objection”
that was seconded by Commissioner Bernardi. The resolutions was revised
to better reflect the application and approved 6-0-0. See attached
Res 03-06
10. WASHINGTON HOME BZA CASE No. 16836 [9:18 pm]
On December 17, 2002 the BZA approved a special exception for
a four-bed addition at the Washington Home and an increase in the number
of parking spaces to 130. The Washington Home was directed to file
a revised site plan, and landscaping plan for the parking lot and a parking
management plan. The plans have not been filed or made available
to the community or ANC3F for review.
Commissioner Wiss offered a motion, seconded by Commissioner
Perry, requesting that the BZA, when the plans are filed, reopen the record
for responses to the filing as required by 11 DCMR Sections 3124.2 and
3121.6 of Zoning Regulations. The motion was approved by a vote of 6-0-0.

11. REPORT ON FOREST HILLS TREE AND SLOPE OVERLAY [9:45
pm]
Commissioner Maudlin reported that on March 10, the Zoning Commission
directed the Office of Planning to revisit the TSO template and prepare
a report addressing the concerns of the ZC members, the template issues
in the record of the FH/TSO proceeding and the operation of the existing
overlays. The OP’s report is due for the ZC’s July meeting.
12. ANC3F’S BYLAWS [9:49 pm]
Commissioner Kessler proposed an amendment to Article IV, Section
9(d) regarding the cosigning of checks or withdrawal from ANC accounts.
d. Cosigning Checks: The Treasurer shall with the Chairperson cosign all checks or withdrawal from ANC accounts. In the absence of either or when one of them is also the payee, any other officer on the checking account’s signature card may cosign.
The first reading was moved by Commissioner Kessler and seconded by Commissioner Bernardi and approved 7-0-0 (Commissioner Kessler voting Commissioner Bardin’s proxy.)
13. TREASURER’S REPORTS [9:56]
A. Commissioner Kessler presented the treasurer’s report for
February 2003.
B. Commissioner Kessler presented a Budget for FY 2003.
On motion by Commissioner Kessler, seconded by Commissioner Bernardi after
revising the expenditure to $50.00 for a new telephone and deleting Other
Expenses, the budget was approved.
C. Commissioner Kessler reported that $4,348.11 had been released
to ANC3F for the 1st qtr and $4,657.33 for the 2nd qtr. FY 2003.
He is investigating why the 4th qtr allotment for FY 2002 has not been
received.
14. ADJOURNMENT [10:18 pm]
The meeting adjourned. The next meeting will be held at
the Wisconsin Avenue Baptist Church, 3920 Alton Place, N.W., on April 21,
2003
