    MINUTES

Meeting called to order at 7:45pm by Chair Doug Mitchell. Commissioners Kogan, Perry, Bardin and Fitzgerald were present.

Agenda was unanimously approved.

ANNOUNCEMENTS

Mr. Jim O Donnell of the UDC Institute of Gerontology gave the schedule of events for his organization.

Commissioner Mitchell announced there is a vacancy in ANC3F in SMD06 - Commissioner Robert Spencer has resigned his seat and directed the audience's attention to information about petitioning for this position to the information table in the room. The deadline for application for the position is August 2, 1999.

OPEN FORUM

Mr. Bill Strong expressed concern about a building project at 3901 Connecticut
Avenue. Commissioner Mitchell said the Commission was aware of the project and would
be inviting the developer to give a presentation at the September meeting.

Karen Perry moved to set the agenda aside, on an emergency basis, and that a letter be sent to  DCRA  and other agencies requesting a full environmental impact study, and that ANC3F be part of the permit process for the construction project proposed at 3901 Connecticut Avenue.
Motion passed 5-0-0.

Chair Mitchell announced he will be turning the gavel over to Vice Chair Bardin at 8:45pm, as he needed to leave the meeting.

Mr. Carl Pong owner of Shanghai Gardens restaurant, 4469 Connecticut Avenue presented his plan for use of public space for an out door cafe. The commission voted 5-0-0 to not oppose the plans as presented.

Commissioner Bardin presented the second reading of the two bylaw amendments first read at the June meeting by former Commissioner Spencer. Those amendments were unanimously adopted at the June meeting. Both are amendments to Article 10 Section 3 of Bylaws attached to these minutes. Commissioner Bardin read the proposed amendments. Commissioner Bardin moved to approve these amendments as read. The motion passed 6-0-0 (Commissioner Bardin voting Commissioner Maudlin's proxy).

Commissioner Bardin proposed an amendment to the Bylaws which covers guideline for a quorum - not presently covered by the ANC Bylaws. The proposal is to add a new section 10 at the end of Article 3; Commissioners. Section ten would have three subsections. Commissioner Bardin read the proposed addition (see attached). He moved that this addition be included in the Bylaws. The motion passed 6-0-0. (Commissioner Bardin voted Commissioner Maudlin's proxy).

Chair Mitchell passed the gavel to the Vice Chair at 8:45pm.

Commissioner Bardin acknowledged the attendance of Councilmember Phil Mendelson and Senator Florence Pendleton. He welcomed both to the meeting.

 Police Crime Report
Officer Connor of the Second District Metropolitan Police gave the crime statistics for the past month. She said there had been an attempted car jacking in the neighborhood. She reported that the police are trying to get the DPW to take care of foliage which obscures traffic signs.

REGULAR BUSINESS

Commissioner Bardin introduced the issue of Congress by-passing the jurisdiction of the National Capital Planning Commission (NCPC) to authorize the immediate installation of monopoles by Bell Atlantic Mobile (BAM) in Rock Creek Park and alter NCPC jurisdiction future cases("Daschle Amendment") - due to come up for a vote in the US Senate. Commissioner Bardin turned the gavel over to Commissioner Kogan who chaired this discussion. Councilmember Medelson expressed opposition to the "Daschle Amendment" as contrary to home rule. Residents and neighborhood groups expressed their opposition to the "Daschle Amendment" and installation of these poles. Some of the residents said they favored the monopoles but opposed the "Daschle Amendment". Representative from BAM presented their case for the importance of the poles to provide service to people in the park stressing safety issues, and argued that the NCPC does not really have approval authority anyhow. Commissioner Bardin moved ANC 3F adopt the attached resolution The motion carded 5-0-0 (Commissioner Bardin voting Commissioner Maudlin proxy).

Commissioner Bardin said he would like to send a letters to the Park Service under his signature to ask for a break down of number on crimes and accidents in Rock Creek Park to help assess the need for cellular phones in the park and to BAM's counsel asking for details of BAM study underlying maps of Rock Creek Park it had submitted to the National Park Service~ Commissioner Kogan said he would have no objection to Commissioner Bardin seeking this information from the Park Service and BAM Commissioner Perry moved letters to the Park Service and BAM be sent on behalf of the commission as a whole. The motion passed 4-0-0.

COMMITTEE REPORTS AND UPDATES

The minutes were approved as presented 4-0-0.

Commissioner Kogan moved approval of the Monthly Financial report. The motion passed 4-00.

Commissioner Kogan moved approval of the Quarterly Financial Report. The motion passed 40-0.

The meeting adjourned at lO:OOpm.

Add a new section 10 at the end of Article III. COMMISSIONERS to read as follows:

Quorum

(a)

The Commission may declare a quorum and take official action if a majority of elected representatives of the Commission is present (ie., four out of seven elected representatives; four out of six elected; three out of five elected; or three out of four elected), so long as a majority (four or more) of the seven single-member districts in ANC 3F have representatives on the Commission pursuant to D.C. Code §1-257,

(b)

In the absence of a quorum, Commissioners present at a duly noticed meeting may fix the time to which to adjourn, adjourn, recess or take measures to obtain a quorum.

(c)

Even in the absence of a quorum, the Commission may consider and act upon a resolution to declare a vacancy pursuant to D.C, Code § 1-257(0(2) at a duly noticed meeting.
