1.      CALL TO ORDER [7:34 pm]
Chair Wiss called the meeting to order and, finding Commissioners Kessler, Perry, Maudlin, Bardin, and Bernardi to be present, declared a quorum.

2.      AGENDA [7:35 pm]
The proposed agenda (attached, with “Brief Reports”) was approved, 6-0-0.

3.      MINUTES [7:37 pm]
Minutes of the December 15, 2003, meeting were approved, on motion of Commissioner Maudlin, seconded by Commissioner Kessler.  5-0-1 (Commissioner Bardin abstaining).

4.    ELECTION OF ANC OFFICERS FOR 2004 [7:39 pm]
     The Commission elected officers, effective adjournment of this meeting, as follows (with nominator / seconder and vote in parentheses):
Chair:              Karen Lee Perry     (Commissioners Bardin / Wiss, 6-0-0).
Vice Chair:      David J. Bardin       (Commissioners Perry / Bernardi, 6-0-0).
Secretary:       Cathy Wiss              (Commissioners  Kessler / Bardin, 6-0-0).
Treasurer:       Carl Kessler            (Commissioners Perry / Maudlin, 6-0-0).
    
5.    PARTICIPATION IN ANC SECURITY FUND [7:42 pm]
    The ANC approved attached Resolution 04-01 (Kessler / Perry, 6-0-0).

6.    REAFFIRMING USE OF ANC BANK ACCOUNTS [7:44 pm]
    The ANC approved attached Resolution 04-02 (Kessler / Bardin, 6-0-0).

7.    ANC MEETING DATES FOR REMAINDER OF 2004 [7:45 pm]
    The ANC approved the proposed meeting dates on the reverse side of the attached Agenda after changing the last date to December 13 (if necessary) (Wiss / Bardin, 6-0-0).  The location of meetings (other than the February 9 meeting) was not set.

8.    ANNOUNCEMENTS [7:47 pm]
    A.    Announcements by Commissioners:  None.
    B.    Announcements by members of the community:
    Barbara Beelar (3505 Tilden) announced circulation of a petition of concern that Sidwell Friends School plans to submit an expansion proposal to the BZA without serious consultation.
    Connie Badillo announced a Wellspring Diabetes Program (to change habits, give skills, reduce medication needs) coming January 26 to the Capital Memorial Church:  A 28-day out-patient program that mimics a 19-day residential program developed and offered in Oklahoma.
    Mary Ann Floto from the Mayor’s office announced:
      She was presenting a large scale ANC map, suitable for framing, to Chair Wiss and distributing smaller maps.
    On January 20, Councilmember Patterson’s Private School Task Force is presenting at St. Columba’s Church.
    On February 3, Mayor Williams will address the State of the District at Lincoln Theatre.
    On February 11, Mayor Williams will be in Ward 3 at Metropolitan Memorial Church, 3401 Nebraska Avenue, from 7-9 pm.
    The MPD and the Mayor have released the new PSA boundaries.

9.      OPEN FORUM [7:57 pm]      
    Carol Woodard (3003 Van Ness) asked the commissioners to use the mikes.

10.      MPD SECOND DISTRICT REPORT [8:00 pm]
    Lt. Aiello reported  49 criminal cases in ANC 3F between December 8, 2003, and January 8, 2004, including two robberies, one assault, seven burglaries, nine thefts of articles, 16 thefts from autos, four stolen autos, and one attempt to steal an auto.
    Lt. Aiello and Commissioner Bardin discussed investigation of an attempted theft from the common mail room of The Saratoga and The Chesapeake on November 14 and whether there is room to improve coordination between MPD and the U.S. Postal Inspector.
    Commissioner Perry expressed concerns about increasing numbers of crimes reported monthly and adequacy of MPD staffing in this neighborhood.
    Marvin Tievsky (3810 Warren) urged that monthly crime statistics be conformed to ANC boundaries.
    John Ritchotte (4309 37th Street) asked about students from Wilson High School wandering around.  Lt. Aiello said MPD have extra patrols around Deal J.H.S. and Wilson H.S.

11.    DISCUSSION WITH COUNCILMEMBER KATHY PATTERSON [8:19 pm]
    Ward 3 Councilmember Kathy Patterson summarized several developments, answered questions, and stayed to hear some of the ANC issues that followed.
    Decision on new PSA maps (available at www.mpdc.dc.gov) will reduce the number of PSAs from 83 to 43 with a minimum of 21 police officers per PSA.  Within the next 60 days, the DC Council will hold a public information hearing (but without power to change PSAs).
    She urged Democrats to vote tomorrow.
    Real property tax relief measures will come before the DC Council a week from Tuesday.  Alternative measures have been developed and a compromise may emerge.
    Responding to Nina Kraut (3815 Yuma), DCPS is indeed moving City-wide toward a uniform pattern in which elementary schools (such as Janney) offer K-5, Deal becomes a middle school (6-7-8), Wilson offers 9-12.  But these changes are still a couple of years away.   She plans a town meeting on schools issues in next month or two.
    Discussed with Matt Pavuk (4426 Grant Road) transfer by NPS to DC Parks & Recreation of operation of federally-owned land at Fort Reno Park and hope it will help meet playing fields needs of Wilson H.S.
    Marlene Berlin (4526 30th Street) thanked Councilmember Patterson for the Fort Reno initiative and progress toward restoration of the Wilson swimming pool.  “It’s not yet a done deal,” was the response.
    Responding to Commissioner Bardin asking whether her persistent efforts to bolster restoration of four public libraries were bearing fruit (now that the RFP is 13 months old), she said reprogramming of funds should be accomplished a day hence and a contract finally awarded within days thereafter.
    She told Commisisoner Wiss that award of a new construction contract for the Tenley fire house is supposed to be imminent.  Fire and EMS has the lead, but it is actually the under-writer who schedules replacement of the defaulted initial contract.    
    Responding to Commissioner Perry’s inquiries as to uses of Homeland Security funds provided to DC, the Councilmember  explained that funding did pay for more police, for more fire trucks, and for emergency radios that can actually communicate with dead zones.
    Chuck Ludlam (4020 Reno Road)  and Dick Potter (3003 Van Ness) also dialogued.

12.     JENNY WAELDER HALL CENTER FOR CHILDREN APPLICATION TO BZA
     NO. 17105 FOR SPECIAL EXCEPTION TO OPERATE CHILD DEVELOPMENT
     CENTER NURSERY SCHOOL AT CAPITAL MEMORIAL CHURCH, 3150
     CHEASAPEAKE STREET [8:45 pm]

    Present to explain the Center’s nursery school proposal and to answer questions were Caroline James (4711 32nd Street), a Trustee,  Margie Brickley (Takoma Park, MD), Director,
Paula G. Atkeson, D.S.W. (3000 Connecticut Ave, NW #206, DC 20008, 202-265-0844), Trus-tee, Barbara P. Jones, Ph.D., Trustee (4331 Forest Lane, NW, DC 20007, 202-364-9367; didn't speak); Aimee R. Nover, D.S.W. (6764 Brigadoon Drive, Bethesda, MD 20817, 301-229-2090), Trustee, Robert A. Nover, M.D. (5410 Connecticut Ave, #111, DC 20015, 202-362-6320), Trustee, and Nathan W. Gross, AICP, Zoning and Land Use Specialist, Arnold & Porter (555 Twelfth Street, NW, DC 20004, 202-942-5956).  They distributed a new set of BZA conditions to which the Center is agreeable, revised as of 6 pm that evening (and which they later agreed to amend further, in light of discussion at the meeting).
    One neighbor expressed support for the proposal, sharing a copy of a contract by which the Center promises not to expand into residences in the neighborhood (Gary Stevens  of 3100 Chesapeake).  The President of the Forest Hills Citizens Association (George Clark, 4525 28th Street) expressed FHCA’s satisfaction with resolution of issues by the revised conditions.
    Neighbors Susan Kemp (4616 30th Street) and Jane Heath (3011 Gates Road) expressed concerns as to traffic and/or use of the Forest Hills Playground.
    During discussion among the ANC commissioners that followed, representatives of the Center agreed to modify in a few respect the BZA conditions to which the Center would be agreeable (and those conditions, so modified, are referred to in and appended to ANC resolution 04-03 (attached).  After a motion to approve that resolution (Bardin / Bernadi), two proposed amendments failed to carry:
    Proposed amendment #1 (Perry / Kessler) [school will form a neighborhood coordinating committee and hold meetings as necessary] failed, 2-4-0 (Perry, Kessler in the minority)
    Proposed amendment #2 (Perry / Kessler) [school will cooperate and work with Friends of Forest Hills Playground to keep playground clean and well maintained]  also failed, 2-4-0.
    The underlying Resolution 04-03 was then approved, 5-1(Perry)-0)

13.    UPPER WISCONSIN AVENUE CORRIDOR STUDY STATEGIC FRAMEWORK
    PLAN [9:30 pm]

    Commissioner Wiss described the background and her proposed resolution.  Speakers included John Ritchotte, former Commissioner Phil Kogan (3634 Veazey Street),     Rich Levine (3804 Alton Place), Jean Pablo (3640 Verplanck Place), Cindy Petkac of OP, who can be reached at 442-7617 (direct dial) or Cindy.Petkac@dc.gov.

    Commissioner Bernardi had to leave.

    Additional speakers thereafter included Matt Pavuk, Phil Kogan, Mary Alice Levine (3804 Alton Place), Marvin Tievsky.
    Resolution 04-04 (Wiss / Perry) was approved, 6-0-0 (Bardin voting Bernardi proxy)

14.    TRAFFIC CALMING MEASURES FOR UPTON STREET BETWEEN RENO
     ROAD AND WISCONSIN AVENUE AND ADDITIONAL STUDY OF TRAFFIC
    VOLUME, SPEED, AND CONGESTION ON NEARBY STREETS [10:25 pm]

    Speakers included Chuck Ludlam (4020 Reno Road), Joyce Cowan (3730 Van Ness Street, who said she spoke for 140 petition signators), Wayne and Dina Curtis (3685 Upton Street).
    The ANC approved Resolution 04-05 with friendly amendments accepted by mover and seconder (Kessler / Bardin), 6-0-0 (Bardin voting Bernardi proxy).

15.    TREASURER’S REPORT FOR DECEMBER 2003 [11:05 pm]
    The ANC received and noted the Treasurer’s Report for December 2003.

16.    ADJOURNMENT [11:10 pm]
The meeting adjourned.  The ANC will next meet at a regular monthly meeting, at the Wisconsin Avenue Baptist Church, 3920 Alton Place, N.W., on Monday, February 9, 2004, at 7:30 pm.
