1. CALL TO ORDER [7:30 pm]
Chair Perry called the meeting to order and,
finding
Commissioners Kessler, Maudlin, Bardin, and Dennis to be present,
declared
a quorum. Commissioner Wiss arrived.
2. AGENDA [7:31 pm]
The proposed agenda, attached with brief reports,
was
approved on motion of Chair Perry, seconded by Commissioner Wiss, 6-0-0.
3. MINUTES [7:32 pm]
Minutes of the January 12, 2004, public meeting were
approved
6-0-0, on motion of Commissioner Bardin, seconded by Commissioner
Maudlin.
4. ANNOUNCEMENTS [7:33 pm]
A. Announcements by Commissioners:
Commissioner Maudlin announced that the proposed regulations for the
Urban
Forestry Act of 2002, were published in the D.C. Register on February
6,
2004, for a 30-day comment period. The proposed regulations have
been
posted on the ANC web site, www.anc3f.org.
Commissioner Bardin invited the community to a presentation by Bill
Beck
of the Urban Forestry Administration about construction techniques to
preserve
mature trees at noon on February 10, 2004, at the Reeves Center, 2000 –
14th
Street, N.W.
Commissioner Wiss announced that the Ward 3 Neighborhood Citizens
Summit
will be held at the Metropolitan Memorial United Methodist Church, 3401
Nebraska
Avenue, N.W. at 7:00 pm on Wednesday, February 11, 2004.
Commisioner Wiss also announced that the D.C. Office of Planning will
be
holding a public hearing on the Upper Wisconsin Avenue Strategic
Framework
Plan on February 17, 2004, at 7:00 pm at St. Columba’s Church.
Anyone
wishing to testify should let Cindy Petkac of OP know by Friday,
February
13.
Commissioner Perry announced that Hillwood Museum is recruiting
volunteers
in a number of capacities for the museum and greenhouse. Bill
Johnson,
Hillwood’s volunteer coordinator, will hold a meeting on Saturday,
February
14, 2004, for those interested. The meeting will be at 11:00 am
in
the social room of the Van Ness East Building, 2939 Van Ness Street,
N.W.

B. Announcements by members of the community:
Dick Potter, 3003 Van Ness Street, N.W., announced that the return
envelope
included with the D.C. tax forms this year requires more postage than
regular
first class mail because of its large size.
5. OPEN FORUM [7:39 pm]
No one raised any issues during open forum.
6. MPD SECOND DISTRICT REPORT [7:40 pm]
No representative from the Second District attended
to
give the police report.
7. PUBLIC SPACE APPLICATION TO CONSTRUCT A NEW
DRIVEWAY
WITH PARKING PAD AT 2805 CHESTERFIELD PLACE, N.W. [7:41 pm]
Commissioner Maudlin informed the Commission that he
had
sent a letter to all immediate neighbors informing them of the
application,
which he believed to be straightforward, but that he had received no
responses.
Travis Price, the owner of the property, introduced himself and made
himself
available to answer questions.
When no questions were raised, a motion not to object to the
application
(Maudlin/Bardin) was approved 6-0-0.
8. SIDEWALK ON THE EAST SIDE OF RENO ROAD BETWEEN
YUMA
AND APPLETON STREETS, N.W. [7:43 pm]
Amy Vincent of 3647 Alton Place, N.W., presented a petition signed by
48
residents representing 36 households in the 3600 blocks of Alton Place,
Albemarle,
Appleton, and Yuma Streets, and the single house in this area fronting
on
Reno Road. The petition includes signatures of owners of all four
homes
abutting this stretch of Reno Road. The petition was generated
because
of the difficulty residents have experienced trying to walk and push
baby
strollers along busy Reno Road to the traffic light at Albemarle
Street.
The Commission approved Resolution 04-06
(Kessler/Bardin)
6-0-0 after friendly amendments were accepted: Maudlin (strike
the
final resolution clause concerning restriping crosswalks with
luminescent
paint); Perry (add “”representing 36 homes” after “48 signatures” in
the
sixth “whereas” clause); and Wiss (add to the resolution clause “taking
special
care to protect street trees” in constructing the new sidewalk).
The Commission deferred to a later meeting whether to request a
“walk/don’t
walk” signal at the traffic light at Reno Road and Albemarle Street and
whether
crosswalks should be remarked with luminescent paint.
9. SUPPLEMENTAL RESOLUTION RE: DRAFT UPPER
WISCONSIN
AVENUE CORRIDOR STUDY STRATEGIC FRAMEWORK PLAN [7:59 pm]
Commissioner Wiss reported on a meeting just held
between
Mayor Anthony Williams and members of the community about the Upper
Wisconsin
Avenue Corridor Study. Mayor Williams stated that the process to
develop
the plan should strive toward reaching a consensus, which he does not
equate
with unanimity, but noted that he is committed to transit-oriented
development
and smart growth. Andrew Altman, Director of the Office of
Planning,
said he would not commit to proceeding with the plan only after
approval
by the affected ANCs, but instead would consider the needs of the city
as
a whole.
Commissioner Wiss then introduced a resolution asking for additional
revisions
to the Draft Plan beyond those requested in Resolution 04-04, which was
approved
by the ANC in January 2004: (1) to add Tenley Circle, the
Wisconsin
Avenue Baptist Church, and other properties zoned R-1B around Tenley
Circle
to the Growth Restriction Area; (2) to reduce proposed building heights
along
Wisconsin Avenue between Chesapeake and Ellicott Streets to protect
views
of Virginia from Fort Reno; (3) to consider whether to develop a zoning
overlay
to protect sightlines of Civil War sites from Fort Reno; and (4) to
request
that OP delay resubmitting a revised Draft Plan to the community in
order
to conduct full, independent analyses of the impact of potential
development
on the area’s infrastructure and to refrain from sending a plan to the
D.C.
Council until a consensus has been reached. Barbara Simons of

Linnean Avenue, Henry Guyot of 4108 – 38th Street, and George Clark of
4525
– 28th Street commented and asked questions.
The ANC approved Resolution 04-07 (Wiss/Perry) 6-0-0 with two friendly
explanatory
amendments moved by Commissioner Bardin.
10. UPDATE ON TRAFFIC CALMING MEASURES FOR UPTON
STREET
BETWEEN RENO ROAD AND WISCONSIN AVENUE [8:23 pm]
Commissioner Kessler reported that the resolution
requesting
traffic calming devices and additional study has been submitted to
DDOT.
Funding is available to start some of the requested work in the spring.
11. UPDATE ON ANC PROTEST OF LIQUOR LICENSE FOR
CVS
AT 5011 CONNECTICUT AVENUE, N.W. [8:24 pm]
Commissioner Maudlin reported that ABRA sent the ANC
a
letter on January 23, 2004, stating that because the ABC Board had
accepted
the licensee’s explanation for failure to appear at the January 7,
2004,
roll call hearing, the application had been reinstated. A new
roll
call hearing, at which the ANC must appear, is scheduled for March
10.
If both the protestor (ANC) and applicant are present, the ABC Board
will
schedule a hearing on the application for a later date. The
designation
of Commissioners Bernardi, Maudlin, and Kessler to represent the ANC in
this
matter (December 15, 2003, ANC meeting) remains in force.
12. TREASURER’S REPORT FOR JANUARY 2004 [8:27 pm]
Commissioner Kessler presented the report for
January
and informed the Commission that because paperwork to participate in
the
ANC Security Fund had been filed, the Commission would be able to write
checks
in February.
13. QUARTERLY REPORT FOR THE FIRST QUARTER OF FY
2004
[8:30 pm]
The ANC approved the quarterly report
(Kessler/Dennis)
6-0-0.
14. RESOLUTION REGARDING THE TRANSFER OF MONIES TO
THE
ANC SAVINGS ACCOUNT [8:34 pm]
The ANC approved Resolution 04-08 to transfer
$10,000
from the ANC checking account to the savings account (Kessler/Dennis)
with
a friendly amendment by Commissioner Perry, 6-0-0.
15. UPGRADE OF ANC INTERNET SERVICE PROVIDER [8:40
pm]
On motion of Commissioner Bardin, seconded by
Commissioner
Dennis, the ANC authorized the chair and treasurer to spend up to $200
to
subscribe to Juno Platinum service, 6-0-0.
16. ADJOURNMENT [8:43 pm]
The meeting adjourned. The next regular
monthly
ANC meeting will be at the Capital Memorial Church, 3150 Chesapeake
Street,
N.W., on Monday, March 15, 2004, at 7:30 pm.
