1. CALL TO
ORDER [7:30 pm]
Chair Wiss called
the meeting to order and, finding Commissioners Kessler, Perry, Maudlin,
and Dennis to be present, declared a quorum. The Chair announced
that Commissioner Bernardi was unable to attend.
2. AGENDA
[7:47 pm]
Commissioner Bardin
arrived. The proposed agenda [attached] was amended to add discussion
of subdivision of 2800 Chesterfield Place at or near the end on motion
of Commissioner Maudlin, seconded by Commissioner Perry, 6-0-0. The
agenda as so amended was approved by consensus, 6-0-0.
3. SCHEDULING
SPECIAL MEETING [7:48 pm]
On motion of Commissioner
Dennis, seconded by Commissioner Maudlin, the ANC voted 6-0-0 to hold a
special meeting on Monday, February 17, 2003, at 7:30 pm at 2800 Chesterfield
Place to consider the new application to the Commission of Fine Art.
[Secretarys Note: The special meeting was publicly noticed but had
to be cancelled because of snow.]
4. MINUTES
[7:49 pm]
Minutes of the January
13, 2003, meeting were approved, on motion of Commissioner Bardin, seconded
by Commissioner Kessler. 6-0-0.
5. ANNOUNCEMENTS
[7:50 pm]
A. Commissioner
Maudlin announced revised plans for 2800 Chesterfield Place were available
for inspection in the room.
B. Commissioner
Bardin reported that a Teach-In was scheduled for the next day, February
11, from 1-5 pm, at Washington Hebrew Congregation, 3935 McComb St., NW,
about Waging Peace & Justice, Budget Choices, Taxes, Civil Rights,
Medicaid, Head Start, & more.
C. Commissioner
Wiss announced a meeting at Tenley Library on February 27 at 7 pm to review
plans for the new library.
D. Commissioner
Bardin reported on the DC Council oversight hearings involving DCRA (Feb.
7) and OZ (Feb. 10) at which Chair Sharon Ambrose expressed support for
moving quickly to shift from DDOT to DCRA responsibility for permitting
sidewalk cafes and discussions of possibly relocating BLRA and the Zoning
Administrator.
E. Henry Guyot,
Commissioner Wiss and Commissioner Perry reported on the charette just
completed regarding Wisconsin Avenue, and attendance by Commissioners Wiss
and Bernardi.
6. OPEN FORUM [8:00 pm] There were no items.
7. MPD SECOND
DISTRICT REPORT [8:00 pm]
Officer Connor (of
the 4th watch, from 7:30 pm to 4 am, of PSA 291) and Lt. Aiello appeared.
During January, in the boundaries of ANC 3F, Lt. Aiello reported 1 assault,
5 burglaries, 10 thefts, 7 thefts from auto, and 8 stolen autos.
He provided additional specifics as to day of week and circumstances of
the reported crimes and exchanged information with and from members of
the community. Commissioner Maudlin asked why the the Second District
Commander had not responded to an e-mailed inquiry as to theft of personal
articles from a car parked at rear of a Nebraska Avenue home in early January.
Officer Connor took his phone number and promised a prompt response.
In response to a question from Dick Potter, Lt. Aiello said that PSAs are
all under review with decisions due soon, except that war/terrorism issues
may again delay decisions.
8. SHERIDAN
SCHOOL [8:12 pm]
The Sheridan School
has asked for a continuance from the BZA. Scott Schachter, who lives
across the Street from the School, asked assurances that the School would
not object to a commensurate extension of time in which neighbors may apply
to the BZA for party status. Attorney Jacque B. DePuy, representing
the School, said his client would not object. On motion of Commissioner
Kessler, seconded by Commissioner Wiss, the ANC approved the attached letter
to the BZA, 6-0-0.
9. CLOSING
OF PUBLIC ALLEY BEHIND 3425 GARRISON STREET [8:26 pm]
Ms. Patricia T. Rosenman
explained her need to use the unpaved, dead-end alley to enable her to
park her car off street. Commissioner Maudlin explained that he had
contacted the neighbors with no objection and the closes neighbor expressing
support. On motion of Commissioner Maudlin, seconded by Commissioner
Bardin, the ANC voted no to object to Ms. Rosenmans request to the Office
of the Surveyor, 7-0-0 (Commissioner Bardin voting Commissioner Bernardis
proxy in favor).
10. FOREST
HILLS TREE AND SLOPE PROTECTION OVERLAY [8:35 pm]
The Chair allowed
equal time, 10 minutes, for points by proponents and opponents of an overlay.
Speakers generally in favor included George Clark, Marjorie Rachlin, Alex
Walworth. Those generally opposed included Michael Jones, Karen Foreit,
Jim Foreit. Ms. Foreit reported that she planned to file with the
ZC a petition to exclude from the overlay all squares south of Soapstone
Creek but did not furnish a copy to the ANC. They and David Swanson
also asked questions about procedures that the ZC would likely follow.
Commissioner Bardin moved, and Commissioner Kessler seconded,
the attached resolution, Res 03-04. Commissioner Maudlin moved amendment
of the resolution to recommend exclusion of all squares south of Soapstone
Creek from the overlay. That motion failed for lack of a second.
The ANC then approved Res 03-04, 6-1-0 (Commissioner Maudlin dissenting,
Commissioner Bardin voting Commissioner Bernardis proxy in favor).
11. INTERIM
REPORT FROM AD HOC COMMITTEE ON PROPOSED AMENDMENTS
TO THE DEFINITION OF
BUILDING, HEIGHT OF IN THE ZONING REGULATIONS,
11 DCMR 199 [9:53 pm]
Commissioner Bardin
requested addition of Mark Baughman, Marjorie Rachlin, and Warren Watts
(each of whom is willing to serve) to the ANCs Ad Hoc Committee on Building
Height and the ANC agreed by consensus, 6-0-0.
Co-chair George Clark presented a brief interim report.
Commissioner Bardin said he would prepare a single-commissioner
written comment to the ZC on its Case No. 02-35, for filing before the
March 14 hearing, addressing one aspect of the narrow issue set for hearing
and also indicating that a further examination of other issues, as suggested
by the OP and by ANC 3D might be in the public interest. He will
circulate a draft of his letter to give other commissioners a chance to
join.
12. 3901 ALBEMARLE STREET
DRIVEWAY CURB CUT APPLICATION [9:59 pm]
On motion of Commissioner
Maudlin, seconded by Commissioner Dennis, the ANC agreed by consensus,
6-0-0, not to oppose the application (which is for the same drive way included
in the plans that the ANC reviewed positively last year).

On motion of Commissioner
Bardin, seconded by Commissioner Kessler, the ANC approved, 6-0-0, the
attached letter, Ltr 03-02.
15. SUBDIVISION
OF THREE LOTS, INCLUDING 2800 CHESTERFIELD PLACE [10:10 pm]
On motion of Commissioner
Maudlin, seconded by Commissioner Dennis, the ANC approved the attached
letter to DCRA Director Clark, 6-0-0. Ltr 03-03.
16. PROPOSED
AMENDMENTS TO ANCS BY-LAWS, 2nd READING [10:18 pm]
On motion of Commissioner
Bardin, seconded by Commissioner Maudlin, the ANC approved the attached
By-Laws amendments on second reading, 6-0-0, making them effective.
17. TREASURER'S
REPORT [10:20 pm]
Treasurer Kessler
presented and explained the proposed report to the DC Auditor for the First
Quarter of FY 2003. On motion of Commissioner Maudlin, seconded by
Commissioner Perry , the ANC approved that Report [attached], 6-0-0.
Treasurer Kessler presented and explained the monthly report
for January 2003.
18. ADJOURNMENT
