1.CALL TO ORDER [7:31 pm]
Chair Wiss called the meeting to order and, finding Commissioners Kogan, Perry, Maudlin, and Bardin to be present, declared a quorum.
2.AGENDA
The proposed agenda [attached] was approved on motion of Commissioner Wiss, seconded by Commissioner Perry, 5-0-0.
3.MINUTES
Minutes of the November 18, 2002, meeting were approved, 5-0-0, on motion of Commissioner Bardin, seconded by Commissioner Maudlin.
4.ANNOUNCEMENTS [7:36 pm]
A.Building Heights Zoning Regulation Hearing:Commissioner Wiss announced that the Zoning Commission has scheduled a hearing for January 30, 2003, at 6:30 pm,for a text amendment regarding building heights and that ANC 3D is proposing a different amendment.In order that the ANC receive sufficient information and analysis in time for consideration at its next meeting, on January 13, 2003, she appointed with ANC concurrence an ad hoc committee consisting of Commissioners Perry and Bardin (and herself, ex officio, as ANC Chair, as prescribed in the By-Laws) and George Clark, Daryl Grinstead, Brendan Herron and Barbara Simons.Commissioner Bardin and George Clark agreed to co-chair the Committee.Members of the community are invited to offer comments.
B.Barbara Kogan announced (1) a number of developments and changes as to labeling of “organic” food products (with Whole Foods, formerly Freshfields, in Tenleytown offering substantial printed information); and (2) that Ralph Nader is trying to raise $350,000 for D.C. Public Libraries.

6.MPD SECOND DISTRICT REPORT [7:48 pm]
No one appeared from the MPD.Commissioner Bardin called attention to Virginia Record’s e-mails of information from PSA 201 on recent crimes and enforcement results, such as a recent arrest of rifle-wielding bandits.[Her e-mail address:recordvo@aol.com]
7.BOARD OF APPEALS AND REVIEW Docket No. 02-5863-BP, APPEAL BY BRENDAN HERRON FROM DCRA ISSUANCE OF BUILDING PERMITS FOR 2900 AND 2902 ALBEMARLE STREET, NW [7:50 pm]
On motion of Commissioner Maudlin, seconded by Commissioner Bardin, the ANC ratified Commissioner Kogan’s letter of December 8, 2002, to the BAR.(5-0-0, see Ltr 02-6, attached.)
On motion of Commissioner Bardin, seconded by Commissioner Perry, the ANC approved making a request to the BAR to allow the ANC to become a party and participate in the BAR proceedings, designating Commissioners Kogan, Maudlin and Bardin to represent the ANC.5-0-0.
8.PROPOSED
APPEAL TO THE BZA REGARDING THE SUBDIVIDED 2900 ALBEMARLE STREET SITE AND
DCRA ISSUANCE OF BUILDING PERMITS [8:01 pm]
On motion of Commissioner Kogan, seconded by Commissioner Perry, the ANC adopted Resolution 02-40 [attached] (4-1-0, Commissioner Maudlin dissenting from the ANC’s co-filing the appeal with Mr. Herron, although supporting an appeal).
On motion of Commissioner Perry, seconded by Commissioner Kogan, the ANC adopted Resolution 02-41 [attached] designating Commissioners Kogan, Maudlin, and Bardin to represent it before the BZA.
9.TREASURER’S
REPORT [8:35 pm]
The Commission received the Treasurer’s Report for November 2002, distributed on his behalf, in his absence, by Chair Wiss.
10.ADDITIONAL BUSINESS [8:41 pm]
Chair Wiss noted that this was the last meeting for three Commissioners, including Commissioner and Vice-Chair Kogan.She summarized his many accomplishments as a Commissioner, and expressed her hope that he will continue his community service even after his term ends.Commissioners and community applauded heartily.
Commissioner Kogan responded graciously, appraising contributions toward realization of the commonweal made by each commissioner with whom he has served.
11.ADJOURNMENT [8:47 pm]
On motion of Commissioner Bardin, seconded by Commissioner Wiss, the ANC adjourned (5-0-0).The next meeting will be held at Capital Memorial Church, 3150 Chesapeake Street, on January 13, 2003, at 7:30 p.m.
