Dear Mr. Downing:
Reference is made to your letter of October 11, 2001 transmitting to ANC3F for comment an application to occupy public space for a proposed bridge and retaining walls at 2800 Davenport Street, N.W.
As noted on the enclosed endorsement to your letter of October 11, 2001 ANC3F has objections to the proposed bridge and retaining walls as shown in the drawings enclosed with your letter.
The applicant has advised ANC3F by letter dated November 14, 2001 that an application for a construction permit for the bridge and retaining walls was filed with DCRA on November 8, 2001. The drawings filed with the construction permit application differ from the drawings filed with the application for the public space permit.
ANC3F voted 6-0-0 at a public meeting on November 19, 2001, with a quorum present, not to object to a public space permit for the bridge and retaining walls as per plan filed November 8, 2001 for a construction permit subject to the following conditions.
1. That the ordinary high water marks on both sides of the stream be established so that a determination can be made regarding federal jurisdiction of the bridge and retaining walls.
2. That if any tree in the public space is removed or destroyed
that it be replaced with a tree of similar size and type and as close as
possible to the area where the tree was

Please advise ANC3F if this permit application will be considered at a public space committee meeting.
